LEGAL · REVIEW DRAFT
Terms of Service
Clear responsibilities for the work Emi prepares and the content you approve.
1. Service and operator
These draft terms describe the proposed relationship between a customer and the operator of Tellemi (“Tellemi,” “we,” or “us”). Tellemi provides AI-assisted creation and preparation of social media marketing content for licensed real estate agents, initially in Florida.
Emi is the service’s AI assistant persona. Emi is not a human employee, broker, lawyer, or licensed real estate professional. Tellemi does not provide brokerage services, legal advice, or a certification of regulatory compliance.
Before these terms become effective: the final version must identify the legal operating entity, business contact address, effective date, and approved billing and dispute terms. This draft does not resolve the operator identity discussed under prior Bullhorn or Uppfront working names.
2. Eligibility and account responsibilities
The service is intended for adults using it for professional business purposes. You must have authority to act for the business or brand you associate with your account and maintain any license or permission required for your activity.
Provide accurate account information, review any professional profile details retrieved from public sources, and keep your account credentials and connected social accounts secure. Tell us promptly about suspected unauthorized use. Do not share access with someone who lacks authority to act for you.
3. Requests and supplied materials
You may provide instructions, listing facts, brand assets, and other authorized materials through supported service channels. Email and the web portal are described as the launch channels. SMS and a native mobile app are coming soon and should not be relied on as available services.
You are responsible for having the rights and permissions to submit and publish your materials. Do not submit confidential client information, financial account details, government identification numbers, information about minors, or other sensitive information unnecessary to create a marketing post.
By submitting material, you authorize processing and use necessary to provide the requested service, create drafts, store your work, and publish content you approve. This permission is limited to operating the service and any separately agreed use.
4. Human approval and professional review
Every post requires your approval before publication. Review each image, caption, number, address, date, disclosure, attribution, and proposed destination before approving. If you request a revision, review the revised content before approval.
You remain responsible for applicable advertising rules, Fair Housing requirements, brokerage policies, platform rules, required disclosures, listing permissions, and the accuracy of your representations. An automated language check is an aid and does not establish legal compliance.
Approval authorizes publication or scheduling of that content to the destinations you selected. A third-party platform may reject, delay, remove, or alter the presentation of a post. If you identify an error after approval, use available controls and contact support promptly; removal may also require action in the social platform.
5. AI outputs and property information
AI-generated content may contain errors, omissions, misleading phrasing, or content similar to other outputs. Review it rather than relying on it as professional advice or a guarantee of originality.
Available property and professional information may come from public records, licensed data providers, your professional profile, and facts you supply. Coverage, freshness, and accuracy vary. A source and date help you assess information; they are not an independent verification of current property conditions.
You must supply or confirm current listing status, list price, event details, and other time-sensitive facts. An assessed value or automated valuation is not a current asking price. No direct MLS or IDX access is promised by these terms.
6. Content rights
You retain the rights you hold in your supplied materials. Your use of generated content is subject to any third-party rights, licenses, and applicable law. AI-generated material may not qualify for exclusive intellectual property protection, and similar content may be generated for others.
The Tellemi name, service interface, software, and service-owned materials remain the property of their respective owners. These terms do not transfer ownership of the service or grant rights to third-party logos, photographs, maps, listings, or other protected materials beyond permissions applicable to them.
7. Plans, charges, and cancellation
The price, billing interval, included usage, renewal behavior, cancellation method, and any trial or refund terms must be presented clearly before a customer purchases a subscription. This promotional draft does not establish a subscription price, trial offer, refund policy, or usage allowance.
Any final subscription agreement must explain how to stop future renewals and what happens to access and stored work at cancellation. Payment processing may be handled by a payment provider under its own terms. Nothing in the final agreement may remove rights that cannot lawfully be waived.
8. Acceptable use and availability
Do not use the service for unlawful, discriminatory, deceptive, infringing, harassing, or unauthorized advertising. Do not impersonate another professional, misrepresent a listing, bypass security or approval requirements, or interfere with the service.
Access may need to be restricted to protect accounts, comply with law or platform requirements, address abuse, or respond to a material breach of the applicable agreement. Final terms should describe the notice and cancellation process.
Features may depend on external data, AI, email, hosting, payment, or social media services. Tellemi does not promise uninterrupted availability, a fixed generation time, a specific audience reach, leads, sales, or business results.
9. Privacy, changes, and finalization
The Privacy Policy review draft describes the proposed categories of information and service providers involved. The final policy must reflect actual implementation and retention practices.
Any material future changes to effective terms should be communicated through the service or another appropriate channel. Effective date, governing law, dispute procedure, warranty allocation, and any limitation of liability require final review; no arbitration provision or liability cap is established in this draft.
